This Photo and Video Release and Consent Agreement (the “Agreement”) is between Piney Woods Manufactured Home Community (“Company,” “we,” “us,” or “our”) and you (“Participant,” “you,” or “your”).

1. SCOPE OF AGREEMENT

This Agreement applies to you and all individuals accompanying you (including friends and family members) to any event, tour, open house, community gathering, or other function (collectively, “Events”) hosted or sponsored by Piney Woods Manufactured Home Community.

2. GRANT OF RIGHTS

By agreeing to this consent form, you hereby:

a) Grant permission to the Company to take photographs, videos, and audio recordings of you and those accompanying you at Events;

b) Authorize the Company to use, reproduce, edit, exhibit, publish, or distribute these images and recordings for marketing, promotional, advertising, or educational purposes;

c) Consent to such use in any medium now known or hereafter developed, including but not limited to:

• Print materials (brochures, newsletters, flyers)
• Digital and social media platforms
• Website content
• Email marketing
• Advertisements
• Promotional videos

d) Waive the right to inspect or approve the finished product wherein your likeness or the likeness of those accompanying you appears;

e) Waive any right to royalties or other compensation arising from or related to the use of the photographs or recordings.

3. NO OBLIGATION TO USE

The Company is under no obligation to use or publish any materials containing your image or voice.

4. RELEASE OF CLAIMS

You hereby release and forever discharge the Company and its officers, directors, employees, agents, and representatives from all claims, demands, and causes of action which you, your heirs, representatives, executors, administrators, or any other persons acting on your behalf or on behalf of those accompanying you to Events may have relating to this Agreement.

5. REPRESENTATIONS AND WARRANTIES

You represent and warrant that:

a) You are at least 18 years of age and have the legal capacity to enter into this Agreement;

b) You have authority to agree to this consent on behalf of those accompanying you to Events;

c) You have read this Agreement in its entirety and fully understand its contents.

6. DURATION AND REVOCATION

This Agreement shall remain in effect indefinitely. You may revoke this consent for future Events by submitting a written request to info@pineywoodscommunity.com; however, such revocation will not affect any uses or disclosures that occurred prior to the receipt of your revocation.

7. MINORS

If individuals under the age of 18 accompany you to Events, you represent that you are the parent or legal guardian of such minors or have obtained permission from their parent or legal guardian, and you consent to this Agreement on their behalf.

8. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state where Piney Woods Manufactured Home Community operates, without giving effect to any choice of law or conflict of law provisions.

9. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof.

By checking “I agree” on the associated form, you acknowledge that you have read, understood, and agree to be bound by all terms of this Agreement for yourself and anyone accompanying you to Events.
